“Supreme Court Strikes Down Trump Tariffs”

The Supreme Court, by a 6-3 decision, struck down the Trump tariffs.

Chief Justice John Roberts, writing for the majority, was joined by Justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson, Neil Gorsuch, and Amy Coney Barrett.

Writing the dissenting opinion, Brett Kavanaugh was joined by Justices Clearance Thomas and Samuel Alito.

This is a setback for the Administration. A big unanswered question left by the court was whether and how the billions in tariffs collected would need to be refunded.

The Administration had cited statutory authority for the tariffs under the IEEPA, an emergency action tariff provision. There are other trade laws the administration can now utilize to pivot and enact tariff adjustments.

There are workarounds. Stay tuned.
