Hurricanes, tropical storms, and no-name storms are part of life in Florida. Heavy winds and fallen trees are common to all three weather events.
Florida is a no-fault state relative to liability when a tree comes crashing on your property. If your neighbor's tree damages your property, the costs associated with repairs and removing the tree are on you.
That will change if House Bill 599 and Senate Bill 724, dubbed the “Fallen Tree Act,” become law.
If enacted, the owner of the fallen tree would be responsible for the damage and removal.
I support this legislation. The owner of the fallen tree should be responsible for their tree, including removing dangerous, decaying, or dying trees, pruning their trees, and thinning their tree branches to allow for maximum air flow.
No longer should you be on the hook for a neighbor’s fallen tree damage.
