A huge case is heading to the U.S. Supreme Court, including its soon to be newest Justice Neil Gorsuch. Who gets to change the 1964 Civil Rights Act: the courts or the Congress?
Should LGBT rights be added to the list of federal Civil Rights protections?
Is the “sex” protection limited to male and female or should it be interpreted to include LGBT rights?
The 11th Circuit Federal Court of Appeals in Atlanta ruled a few weeks ago in effect that Congress must change the Civil Rights Act by deciding against the LGBT inclusion. The 7th Circuit Federal Court of Appeals based in Chicago just ruled the opposite that effectively the courts do, by ruling for LGBT protections.
So is the Chicago Court of Appeals exercising judicial activism?
A landmark Supreme Court decision will make that call.
