 “Florida’s Ever Evolving Right-To-Privacy”

Bill Bunkley With Something To Think About

Florida’s Constitutional Revision Commission is narrowing down the issues it will bring forward for consideration on the ballot in November.

One major issue taking another step forward is a proposed revision to roll back Florida’s widely expanded right-to-privacy provision.

It’s an issue today thanks to Florida judges who through years of judicial activism expanded a narrow and basic “right-to-privacy” protection originally crafted to protect Floridians from computer technology intrusion into their private lives. Its application in all manner of cases is far afield from its original intent, especially in abortion-related cases.

Florida Family Policy Council President John Stemberger, a member of the CRC, has correctly argued that the right is too widely applied and needs reining in.

It is the Florida legislature’s job to review and set policy in areas requiring right-to-privacy protections, not activist judges.
