“It May Become Harder to Amend Florida Constitution”

Citizens can amend the Florida Constitution directly without going through the Legislature. Doing so may be more challenging if the Legislature passes legislation that voters would later approve in 2024. 

To get a citizens-led Florida Constitutional Amendment on the 2024 ballot, the Division of Elections must collect and certify over 891,000 verified signatures supporting that amendment. Currently, a proposed Florida constitutional amendment requires a minimum of 60% voter approval.

But under SB 1404 by Senator Joe Gruters and HJR 129 by the House Judiciary Committee, that approval would rise to 66.67%.

Many inappropriate items have been inserted into Florida’s Constitution by citizen petition drives.

A higher 66.7% voter approval would hamper inappropriate issues from making it into the Florida Constitution.
