The Roe v Wade abortion-on-demand decision has been the law of the land for 50 years. It is the poster child of judicial activism. Justice Blackmun wrote the decision out of thin air with no legislative underpinnings.
No constitutional scholar or lawyer will legally defend how it was decided.
After yesterday’s Supreme Court oral arguments in the Dobbs v. Jackson Woman’s Health Organization abortion case, Roe could be destined to the ash heap.
The high court will consider three huge issues: precedent, state rights vs. federal rights, and the definition of an unborn baby’s viability, arbitrarily set in Roe by Justice Blackmun 50 years ago.
It will be next summer before the final court decision will be released.
But if overturned, each state will then decide its abortion law.
